10 Influencer Contract Red Flags Every Creator Should Know

Most contract disasters come from standard-looking contracts with one buried clause that turns into a 12-month exclusivity problem, or a $20,000 IP loss.

"Influencer agrees not to promote any competing brand for 90 days from the post date."

Red flag #2 — Full IP transfer

"Influencer hereby assigns all right, title, and interest in the Content to Brand in perpetuity."

Replace with "grants Brand a non-exclusive license for [platforms] for [period]". If they insist, demand 2-3x base rate.

Red flag #3 — Unlimited usage rights

Specify both platforms and duration. Paid social: +30-50%. Full whitelisting: +50-100%.

Red flag #4 — Vague morality clauses

Replace subjective language with specific defined triggers (conviction of a crime, direct attack on the Brand).

Red flag #5 — No kill fee

"If Brand cancels after Influencer has commenced production, a kill fee of 50% shall be paid within 14 days."

Red flag #6 — Net 90+ payment terms

Standard: Net 30. Red flag: Net 90+. Demand 50% upfront.

Red flag #7 — Unlimited revisions

"Up to two (2) rounds of revisions are included. Additional revisions billed at $X per round."

Red flag #8 — Undefined performance metrics

"Payment is NOT contingent on reaching specific performance metrics."

Red flag #9 — Broad indemnification

Narrow it to things you actually control. You are NOT responsible for product safety claims.

Red flag #10 — No creator termination rights

Add a mutual termination clause with 30 days written notice.
